Customs broker GHY International’s updated Section 338 advisory (August 18) flags the detail many exporters miss: the 50% tariff applies based on the date goods enter U.S. customs, not the date they ship. A truck that leaves Calgary Thursday but crosses Saturday pays the full duty.
GHY’s guidance for the run-up to the 12:01 a.m. ET August 22 deadline: confirm arrival timing with carriers and brokers rather than assuming ship dates protect you, prioritize loads with confirmed pre-deadline entry, hold shipments with uncertain timing until the picture clears, and remember that CUSMA status provides no protection under Section 338.
What it means: Call your broker before you book the truck – the difference between Thursday entry and Friday entry is 50 points of margin on the invoice.
